1. Introduction

Welcome to Mashaweer Platform.

These Terms and Conditions set out the rules governing the use of the website, mobile application, and services associated with the Mashaweer Platform. By using the Platform, registering an account, or requesting any service through it, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions.

If you do not agree to these Terms and Conditions, please do not use the Platform or any of its services.

2. Company Information

Mashaweer Platform is operated by Mashaweer Kuwait for Transportation Mediation Through Electronic Applications Company, a limited liability company licensed in the State of Kuwait.

The Company operates under Commercial Registration No. 531697 and License No. 2025/14625. Its licensed activity is transportation mediation through electronic applications, Activity Code 620105.

3. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below, unless the context requires otherwise:

Platform: means the Mashaweer mobile application, website, dashboard, and any related digital services.

Company or Mashaweer: means Mashaweer Kuwait for Transportation Mediation Through Electronic Applications Company.

User: means any person who uses the Platform, whether as a Customer, Driver, or Service Provider.

Customer: means any person who uses the Platform to request transportation, delivery, or any other available service.

Driver or Service Provider: means any person or entity that provides transportation or delivery services through the Platform.

Service: means any service requested or provided through Mashaweer Platform, including transportation, delivery, bookings, or any other services that may be added by the Company in the future.

Booking: means a service request created by the Customer through the Platform.

Electronic Wallet: means the internal financial balance or account, if available, within the Platform.

4. Scope of Application

These Terms and Conditions apply to all users of Mashaweer Platform, including Customers, Drivers, and transportation or delivery Service Providers.

These Terms also apply to all current and future services provided by the Company through the Platform, unless specific terms are issued for a particular service.

5. Nature of Mashaweer Platform

Mashaweer is a technology platform operating in the field of transportation mediation through electronic applications. It aims to connect Customers with Drivers or providers of transportation and delivery services.

Unless expressly stated otherwise, Mashaweer is not the owner or direct operator of all vehicles used by Drivers or Service Providers. The Company’s responsibility is limited to managing and operating the Platform and organizing the connection between the parties to the service in accordance with the laws and regulations applicable in the State of Kuwait.

6. Registration and Account Use

When registering on the Platform, the User must provide accurate, current, and complete information.

The User is responsible for maintaining the confidentiality of account login details and is responsible for all activities carried out through the account.

The Company may refuse to create an account, suspend it, or terminate it if incorrect information is provided, if there is misuse, suspected fraud, or any violation of these Terms or applicable laws.

Users are prohibited from creating fake accounts, sharing accounts with others, using another person’s account, or impersonating any person or entity.

7. Bookings and Service Availability

The ability to accept Booking requests depends on the availability of Drivers or Service Providers, operational conditions, road conditions, geographical location, and the type of service requested.

Mashaweer does not guarantee that the service will be available at all times or in all areas.

The Company, Driver, or Service Provider may reject or cancel a request in certain cases, including unavailability of Drivers, emergency circumstances, incorrect request details, or violation of the Terms of Use.

Arrival times or estimated costs may vary due to several factors, including traffic congestion, road conditions, route changes, waiting time, or other operational circumstances.

8. Prices and Payment

Where available, the Platform displays the price or estimated price of the service before or during the execution of the request.

The price may be calculated based on several factors, including the type of service, distance, trip duration, waiting time, additional fees, cancellation fees, promotions, or any other fees displayed within the Platform.

Available payment methods, subject to what the Company provides, may include:

Cash payment.

KNET.

Visa.

Mastercard.

Apple Pay.

Google Pay.

Electronic Wallet within the application, if available.

Any other payment method approved by the Company in the future.

The User is obligated to pay all amounts due for services requested through the Platform.

In the event of payment failure or an outstanding balance, the Company may restrict account use or suspend some services until the outstanding amount is settled.

9. Cancellation, Waiting Time, and Refunds

The Customer may cancel a Booking in accordance with the policies approved within the Platform.

Cancellation may be free of charge before the Driver arrives or before the service begins, depending on the type of service and the time specified in the cancellation policy.

If the Driver arrives at the pickup location or the service has begun, cancellation fees may apply according to the Company’s policy.

The Driver provides the Customer with five minutes of free waiting time after arriving at the pickup location, unless the service policy or Booking type provides for a different period.

Additional fees may be charged for waiting time exceeding the free period.

Refund requests are reviewed individually by the Company. If a refund request is approved, the amount may be returned to the original payment method or to the Electronic Wallet within the application, as the Company deems appropriate and in accordance with the policies of payment providers.

10. Customer Obligations

The Customer shall comply with the following:

Use the Platform in a lawful and legitimate manner.

Provide accurate information when registering or requesting a service.

Be present at the specified pickup location at the appropriate time.

Treat Drivers, Service Providers, and support staff respectfully.

Pay all fees and amounts due.

Not use the service for any illegal purpose or in a manner contrary to public morals or applicable regulations.

Not cause damage to the vehicle, the Driver, or any other party.

11. Obligations of Drivers and Service Providers

When using the Platform, Drivers and Service Providers shall comply with the following:

Comply with traffic laws and regulations applicable in the State of Kuwait.

Provide accurate information and documents during registration or verification.

Maintain the safety of passengers and goods, according to the type of service.

Maintain professional conduct and deal properly with Customers.

Not carry out fake rides or manipulate requests, prices, or geographical location.

Not share, rent, or allow the use of the account by another person.

Maintain the validity of the vehicle, licenses, and permits required, whenever applicable.

The Company may suspend or terminate the account of any Driver or Service Provider in the event of violating these obligations, repeated complaints, unprofessional conduct, or violation of applicable laws.

12. Prohibited Activities

No User may engage in any of the following activities:

Creating fake or multiple accounts without authorization.

Using another person’s account or sharing the account with others.

Manipulating GPS location.

Creating or accepting fake rides.

Misusing offers, discount codes, or referral programs.

Payment fraud or attempting to evade fees.

Manipulating ratings or complaints.

Attempting to hack, disrupt, or misuse the Platform.

Using the Platform for illegal purposes.

Abuse, threats, harassment, or any inappropriate conduct toward Customers, Drivers, or Company employees.

13. Ratings and Complaints

Mashaweer may use a rating system for Customers, Drivers, and Service Providers to improve service quality.

Low ratings, repeated complaints, or repeated violations may result in a warning, service restriction, account suspension, or account termination.

Users may submit complaints or feedback through the Company’s approved communication channels, and such complaints will be reviewed internally in accordance with the appropriate procedures.

14. Privacy and Data Collection

Mashaweer may collect and use certain data necessary to operate the Platform and provide the services, including:

Account and registration data.

Phone number and contact details.

Geographical location data while using the service.

Trip and Booking data.

Payment data, depending on the payment method used.

Verification photos or documents of Drivers and Service Providers.

Device and usage data to improve Platform performance.

Conversations, reports, or support requests.

This data is used for operating the service, executing Bookings, improving quality, identity verification, fraud prevention, complaint handling, and compliance with legal requirements.

Certain data may be shared with parties connected to the provision of the service, such as Drivers, payment providers, map providers, messaging providers, support teams, or competent official authorities where legally required.

15. Account Suspension or Termination

Mashaweer reserves the right to suspend, restrict, or terminate any account in the following cases:

Violation of these Terms and Conditions.

Providing incorrect or misleading information.

Fraudulent or suspicious activity.

Misuse of the Platform, offers, or payment methods.

Repeated complaints or safety-related violations.

Failure to pay outstanding amounts.

Violation of the laws or regulations applicable in the State of Kuwait.

The Company may take the appropriate action without prior notice in urgent cases or cases involving safety, fraud, or serious violations.

16. Intellectual Property

All rights related to the name Mashaweer, the logo, trademark, design, content, software, databases, and materials published within the Platform are owned by or licensed to the Company.

No part of the Platform, its trademark, or its content may be copied, modified, republished, or used without the Company’s prior written consent.

17. Third-Party Services

Mashaweer Platform may rely on third-party services to operate certain features, such as payment gateways, maps, SMS services, verification services, hosting, analytics, or technical support services.

Such services may be subject to the terms and policies of their providers, and Mashaweer shall not be liable for any malfunction, interruption, or restrictions issued by such third parties, to the extent permitted by law.

18. Limitation of Liability

Mashaweer makes reasonable efforts to provide a stable and secure service; however, it does not guarantee that the Platform will be available without interruption or free from errors at all times.

Mashaweer shall not be liable for delays, traffic congestion, road closures, weather conditions, internet outages, failures of service providers, actions of third parties, or any circumstances beyond the Company’s control.

The Company shall also not be liable for any indirect damages or losses resulting from the use of the Platform, to the extent permitted by law.

19. Force Majeure

Mashaweer shall not be liable for any delay or failure to perform its obligations due to circumstances beyond its control, including natural disasters, government decisions, wars, disturbances, strikes, internet outages, general technical failures, or any other emergency events.

20. Amendments to Terms and Conditions

Mashaweer may amend these Terms and Conditions at any time when necessary.

The updated version will be published on the website or inside the application. Continued use of the Platform after the publication of the amendments shall constitute the User’s acceptance of the amended Terms.

21. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and interpreted in accordance with the laws applicable in the State of Kuwait.

In the event of any complaint or dispute, the User must first contact Mashaweer through the official communication channels in an attempt to resolve the dispute amicably.

If an amicable settlement cannot be reached, the competent courts of the State of Kuwait shall have jurisdiction over the dispute.
